Privacy & Security

Last updated February 24, 2026

Safeguarding Your Personal Privacy

Adam & Eve takes your personal privacy extremely seriously. Our company was founded to help protect your privacy, and we’ve gone to court on multiple occasions to defend that right.

We take extra care to safeguard your privacy from the second you land on our homepage to the moment your order arrives at your front door. Here’s just a few of our special measures:

Strong Computer Defenses

Adam & Eve utilizes commercially reasonable, companywide standards for maintaining the privacy and safety of your personal and billing information. While no organization that operates on the internet can ever offer a guarantee of complete security, our safeguards include multi-layered firewalls and virus scans, secured servers, and industry standard computer encryption.

Anonymous Shipping

All Adam & Eve products are shipped as anonymously as possible. Depending on your order, you might receive a plain brown box or white bubble mailing envelope. Because Adam & Eve is a very recognized name, we do not use a company name return address label to protect your privacy.

Discreet Billing

Our efforts to ensure your privacy even extends to your credit card statement. Our name will never appear in your billing statement. Instead, your order will be listed simply as “Adam Mail.”

Adam & Eve’s Privacy Policy

PHE, Inc. is the owner of Adam & Eve. PHE, Inc. (“PHE,” “Adam & Eve,” “AdamEve.com,” “we,” “us,” or “our”) fully understands the need to protect your Personally Identifiable Information (“PII,” as further defined below) and has developed this Privacy Policy (“Policy”) to safeguard your data in accordance with relevant regulations and laws.

This Policy describes how we gather and process your PII throughout our website, located at www.adameve.com (the “Site”). It provides you (a “user, as well as “you,” “your,” and similar terms) with the necessary information regarding your rights and our obligations. It also explains how, why, and when we process your personal data.

By using the Site or obtaining any product or service through this Site, you agree to the limited collection and use of information as outlined in this Policy. If you do not agree to this Policy, please do not use the Site.

Emails from AdamEve.com or its business partners, and the Site itself, may contain links to other Internet websites, including sites that may or may not be owned or operated by AdamEve.com or PHE. Unless otherwise explicitly stated, we are not responsible for the privacy practices or the content of such websites, including their use of any information (such as Internet Protocol (“IP”) address, browser type, unique user ID, or operating system) collected when email recipients or Site visitors click through links to those sites. If you visit such websites, we encourage you to become familiar with the privacy practices of the sites to ensure a safe browsing experience. Emails also may contain html, scripting, analytics, pixels and cookies (further described below) that may transmit PII to our third-party service providers, partners, advertisers and others for purposes of adjusting what advertising you will receive.

We may from time to time update this Policy to reflect changing technology and other factors. We will notify you of changes to the Policy by posting the updated Policy on this page. We ask that you bookmark and periodically review this page to ensure that you remain familiar with the most current version of the Policy.

THE INFORMATION WE COLLECT AND USE FROM YOU

I. Information that you provide to us directly:

We collect PII that you may provide to us through your use of our Site, ordering and purchasing our products, and calling us for information or support through our Website Chat, via email, or otherwise. In so doing, we may gather information such as, but not limited to: first and last name, shipping address, billing address, email address(es), phone number(s), and payment card information.

AdamEve.com also collects PII as needed to provide you with requested services and to process your orders, prevent fraud, and ship your product to you. This information is provided directly by you, such as when you complete the account sign-up form, order form, or email marketing opt-in form and/or when you provide information over the telephone. This information is not part of website analytics and is not disclosed to our website analytics third-party providers. The PII you provide may include the following information, which we use as indicated below:

  • Name — used for order fulfillment and marketing
  • Mailing, Shipping and Billing Addresses — used for order fulfillment and marketing
  • Email Address — used for order status communication and marketing
  • Telephone Number(s) — used for order status communication and marketing
  • Credit Card or Debit Card Number — used for payment for orders

II. Information collected automatically through the use of our Site:

Analytics, Cookies, and Pixels

Our Site utilizes various tracking technologies such as analytics tools, cookies, and pixels to enhance your experience, analyze site performance, and improve the effectiveness of our services. The information gathered with these technologies includes data that in some jurisdictions could be considered PII or sensitive personal information, as well as anonymized non-PII. These technologies work together to collect, process, and sometimes disclose information about your online activities. All such information is collected in real time as one accesses and navigates all areas of our Site and is transmitted in real time to our third-party aggregators, advertisers and analytics providers.

Below is a detailed explanation of each technology and how they function in compliance with laws such as the California Consumer Privacy Act (“CCPA”), Virginia Consumer Data Protection Act (“VCDPA”), Colorado Privacy Act (“CPA”), and other applicable U.S. privacy laws.

Analytics

What are Analytics?

Analytics tools, such as Google Analytics, are software that collects and processes data about how visitors interact with our Site. These tools track metrics like page views, bounce rates, time spent on pages, and other interactions to help us understand and improve the Site’s performance.

How Analytics Work

Analytics software uses tracking codes embedded within our Site to gather information about your browsing behavior, including the pages you visit, the time and date of your visit, your IP address, browser type, and device identifiers. Analytics tools may process this data in combination with other information, such as unique IDs stored in cookies, to deliver more detailed insights.

Information We May Collect

Depending on how you interact with our website, we may collect some or all of the following information:

  • Website usage statistics (pages visited, time on site)
  • IP address and geolocation data
  • Hashed email address
  • Browser type and device information
  • Referring website or source of visit
  • Sensitive personal information (as further defined below).

How Analytics May Disclose Data

The data collected by analytics tools may be disclosed to our third-party service providers or advertising partners. Under some privacy laws, this disclosure could be considered a “sale” of your personal information, especially when combined with data collected through cookies or pixels.

Website Analytics Session Replay

Our Site uses website session replay analytics software that automatically collects information on how you interact with our Site to help us improve the Site by fixing broken links or providing better access to the information you are seeking. Our analytics software collects information such as what pages you visit, links clicked, referring URL, browser and operating system of your device, cookie information, mouse movements as well as text that you enter into forms on our Site - even if you subsequently delete the information typed into a form and do not submit such information. Such information enables us to replay how you interacted with our Site. For the avoidance of doubt, this software does not track anything on your computer – it only tracks signals that your computer sends to our Site when you interact with it. We use various vendors to collect this analytics data, and these types of information are disclosed to them for the purpose of providing their analytics services to us. Your information is not transmitted to such vendors for any other purpose.

Cookies

What are Cookies?

Cookies are small text files stored on your device by your web browser when you visit our Site. They help remember your preferences, enable core site functionality, and track your browsing behavior.

How Cookies Work

Cookies can be either session-based (lasting only while your browser is open) or persistent (remaining on your device after you close your browser). They store data like login credentials, user preferences, and tracking identifiers, which can be accessed by our Site or third parties to enhance your experience or deliver targeted advertising.

Information Collected

  • Unique user identifiers
  • Login information and user preferences
  • Browsing history on our site
  • Interaction with advertisements

How Cookies May Share Data

Cookies work in conjunction with analytics tools and pixels to store and transfer personal information like user IDs and browsing behavior. This information can be shared with third-party partners to deliver personalized ads or analyze user behavior. As defined by certain privacy laws, this data sharing may qualify as a "sale" of your personal information.

How to Control the Use and Sharing of Cookies

When you visit our Site for the first time, or any time after you clear all of your cookies, depending on your geographic location, you may have the ability to adjust what categories of cookies our Site will enable and provide when you navigate our Site.

There are also many free browsers available for your use that have built-in capabilities to block and control cookies, regardless of a website’s usage of cookies.

Categories of Cookies

A cookie is a small piece of data (text file) that a website – when visited by a user – asks your browser to store on your device in order to remember information about you, such as your language preference or login information. Those cookies are set by us and called “first-party cookies.”

We also use “third-party cookies” – which are cookies from a domain different than the domain of the website you are visiting – for our advertising and marketing efforts. More specifically, we use cookies and other tracking technologies for the following purposes:

Strictly Necessary Cookies

These cookies are necessary for the Site to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the Site will not then work. These cookies do not store any user PII.

Functional Cookies

These cookies enable the Site to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies, then some or all these services may not function properly. We may use functional cookies to collect information about how you use the Site and provide this data to our third-party partners for marketing or advertising purposes. Such information may include the fact that you have added items to your shopping cart on our Site (though information about the specific items added to your cart will not be disclosed). Our third-party partners may use the information collected through functional cookies to contact you directly by email, if you have previously opted into those services with a specific third party. You may opt out of receiving these emails by changing your preferences directly with the third-party provider, or by not allowing our site to collect functional cookies.

Performance Cookies

These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our Site as well as the accuracy and performance of our advertising and marketing campaigns. They help us to know which pages are the most and least popular and see how visitors move around the Site. All the information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies, we will not know when you have visited our Site and will not be able to monitor the Site’s performance.

Targeting Cookies

These cookies may be set through our Site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites. They do not store PII directly but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising.

Pixels

What are Pixels?

Pixels, also known as tracking pixels or web beacons, are tiny, invisible images embedded within web pages or emails that track your actions and behavior. They provide valuable insights into the effectiveness of marketing campaigns and track conversions.

How Pixels Work

Pixels activate when you load a web page or open an email, sending information about your activity (such as pages visited, time spent on the site, or interactions with content) back to the server. Pixels often work in conjunction with cookies to transfer more detailed information, such as unique user identifiers, to analytics platforms or advertising networks.

Information Collected

  • IP address and geolocation data
  • User activity on our site (e.g., clicks, scrolls)
  • Time and date of website visit
  • Information from cookies (e.g., unique user IDs)
  • Sensitive personal information (as further defined below).

How Pixels May Provide Data

Pixels often provide information to third-party service providers to measure the effectiveness of advertising campaigns or improve the targeting of ads. This may involve personal identifiers stored in cookies or analytics tools, which could be considered a "sale" of personal information under applicable data privacy laws.

Depending on the service provider or third party that hosts the pixel, you may already have an established account and relationship with that third-party provider, such as Facebook. Because of that, your unique user ID with that third-party provider may be shared with that provider along with the pixel data from our Site.

Pixels also assist us in assessing the accuracy and performance of our advertising and marketing campaigns.

Other Web Tracking Technologies

We may also use other web tracking technologies for the purposes described in this Policy, including but not limited to tags and similar scripts. Additionally, we may use software development kits (“SDKs”) and other developer tools, licensed from third-party providers, for purposes of improving the functionality of our services.

Minors

We do not knowingly sell to, advertise to, communicate with, or otherwise obtain personal information from persons under 18 years of age.

Further, our website is not directed toward persons under the age of 18. We will delete any PII collected that we later determine to be from a user younger than the age of 18. If you are a parent or guardian of a child under the age of 18 and believe your child has provided us with PII, please contact us at:

Data Disclosure and Control

We may disclose the information collected through analytics, cookies, pixels, and other web tracking technologies with third-party partners, such as advertisers or analytics platforms, for purposes such as improving the performance of our Site or delivering targeted ads.

Your Control Over Data Collection

You have the right to control the types of information collected through these technologies by adjusting your preferences in our cookie banner or by adjusting the settings within your browser. You can choose to opt out of certain cookies or limit data sharing for advertising purposes. By refusing or disabling certain cookies, you may still access our Site but some content may not load or work as expected.

Special Category Data and Sensitive Personal Information

Owing to the products that we offer, PHE sometimes needs to process PII about you that in some jurisdictions may be considered “sensitive personal information” (also defined as “special category data,” as those terms are defined in applicable law). This may include information regarding your specific product and category of product interests among our sexual wellness merchandise. Such information may be transmitted to our third-party providers, service providers, contractors and partners as a result of our website analytics.

HOW WE USE YOUR DATA

PHE takes your privacy very seriously and will only use your data for the purpose(s) specified in this Policy. Where you have consented to us providing you with promotional offers and marketing, you are free to withdraw this consent at any time.

AdamEve.com uses certain information that is collected automatically through your use of the Site, such as your IP address and information regarding the pages that you visit on our Site, to help diagnose problems with our servers and to administer our Site and improve Site-related services and features. Your IP address and other information also may be used to gather broad demographic information and to recognize customer traffic patterns and Site usage trends. This information aids us in merchandising and in developing the design and layout of the Site.

We also might provide aggregated statistical data and both PII and non-PII to our current and potential business partners and with our service providers to help them provide similar services.

AdamEve.com sometimes administers online surveys in connection with the Site in which we ask you for demographic information and opinions. We do not ask you for PII as part of any survey. We use any collected survey data on an aggregated basis to better understand the needs of all of our customers.

AdamEve.com uses PII collected from you to complete transactions initiated by you, particularly the sale and delivery of products and services. Your PII is also used to get in touch with you when necessary to provide updates about your order and answer any questions you might have. We also use PII to further develop our marketing efforts to send you ads that are most relevant to your interests.

We may also use PII to contact you to make sure you are satisfied with our goods and services or to find out how we can serve you better. Further, we may use PII to conduct in-depth marketing research regarding our customers and potential customers. Your decision to participate in any survey or questionnaire about this is completely voluntary.

Financial Information

When you order and purchase our products through our Site, our payment card service providers process your payments, and PHE does not process, receive or store your payment card information.

If you order your products through the mail, PHE may directly collect and process your payment card information, including credit/debit card numbers, credit card expiration dates, and the name and billing address associated with your payment card. This information is stored securely, used for processing, and then securely destroyed after thirty (30) days. This payment card information is used solely to process your payments for our products and services. We use commercially reasonable efforts to keep your information secure from theft or fraud.

AdamEve.com also may use your PII to "pre-populate" forms that are used by the Site to facilitate transactions with us and save you from entering every data field on the checkout page.

AdamEve.com may send you periodic announcements regarding your order, status updates, service changes concerning the Site and other administrative matters. You may also, from time to time, receive information from us regarding new features, new products and services, and special offers we think you'll find valuable. If you'd like to opt out of receiving promotional communications from us, please follow the procedure outlined in the “Opting Out” section below.

In addition, there are some special instances when we might use or disclose PII for other purposes:

Service Providers

As described in this Policy, we work with third parties who provide services, including but not limited to website hosting, order processing and fulfillment, age verification, credit card clearance, e-commerce affiliation, data analysis, website analytics, emailing, chat functionality, marketing, targeting, and other services. Some of these third parties may be given access to some or all of the information that you provide to us and may use cookies or other tracking technologies in connection with providing their services.

To the extent that we provide your PII to such third parties, we restrict their ability to use such information for their own marketing purposes. Keep in mind that, while we encourage all third parties involved in helping us run our business to adhere to our policies regarding the privacy of our users and to handle PII in a responsible manner, we cannot and do not assume any responsibility for any actions or omissions of third parties, including the manner in which they use information received either from AdamEve.com or independently.

Related Companies

We may provide personal information we collect about you to related companies for purposes consistent with this Policy for marketing and advertising purposes.

As Required By Law

Subject to applicable law, we reserve the right to release information concerning any Site visitor or user where such visitor or user is believed to be in violation of his or her obligations to us, is partaking (or is suspected of partaking) in any illegal activity, in response to civil subpoenas, court orders and/or discovery requests, to protect the interests of AdamEve.com, our customers, or others, and as otherwise permitted or required by law as regards to these special cases.

Business Transitions

We reserve the right to disclose and transfer all user information: (a) to a subsequent owner, co-owner, or operator of the Site and our services; or (b) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets, or other corporate change, including during the course of any due diligence process.

Consequences of Not Providing Your Data

You are not obligated to provide your personal information to PHE. However, when initiating a transaction, certain personal information is required for us to provide you with our services and deliver your products. We will not be able to offer some or all of our services without it. Should you choose to provide us your personal information for transactional purposes, you may choose not to provide it for other purposes; PHE will still provide you with the services you request even if you do not consent to other kinds of processing.

How Long We Keep Your Data

PHE only ever retains PII for as long as is necessary to serve the purposes described in this Policy. We will also retain and use your PII for as long as necessary to comply with legal, regulatory, accounting or reporting obligations, to resolve disputes, and to enforce our agreements.

Where you have consented to us using your PII for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.

At any time, you can adjust how AdamEve.com markets to you or even opt out of marketing communications completely. To adjust your mailing preferences, simply log into your account and go to the Email Preferences section. Then, select if you want to receive emails and how often you would like to receive them.
